At LekhaWekha (operating under AskUs Consultants LLP), we respect your privacy and are committed to protecting the personal data of our clients (accounting firms) and the data they entrust to us (end-client data). This policy outlines how we collect, use, and safeguard information across the UK, USA, Canada, Australia, New Zealand, Ireland, and India.

1. OUR ROLE: DATA PROCESSOR VS. DATA CONTROLLER

• Data Controller: You (the Accounting Firm) are the Data Controller. You own the data and decide how it should be used.
• Data Processor: LekhaWekha acts as the Data Processor. We only process data based on your explicit instructions to perform accounting, tax, and bookkeeping tasks.

2. INFORMATION WE COLLECT

We collect information in two ways:

1. Directly from You: Contact details (name, email, phone), firm details, and payment information required to manage our business relationship.
2. From Your Clients (End-Client Data): Financial records, tax IDs, bank statements, payroll data, and identification documents provided by you for processing.

3. HOW WE USE YOUR DATA

We process data strictly for:

• Providing the agreed-upon accounting and tax services.
• Managing your 20-hour free trial and subsequent engagement.
• Communicating regarding project queries or updates.
• Complying with statutory obligations in your jurisdiction (e.g., HMRC, IRS, CRA, ATO).

4. DATA SECURITY PROTOCOLS

We implement enterprise-grade security to ensure “Privacy by Design”:

• Secure Access: We primarily work via Remote Desktop (RDP) or VPN, meaning data never leaves your local or cloud servers (Xero, QBO).
• Encryption: All data exchanged via our website or cloud portals is encrypted using SSL/TLS 1.2+.
• Physical Security: Our India-based delivery center features biometric access, a “No-Paper/No-USB” policy, and 24/7 CCTV surveillance.
• Employee NDAs: Every staff member is bound by a lifelong confidentiality agreement.

5. REGIONAL COMPLIANCE & TRANSFERS

5.1 UK & Ireland (GDPR)

We comply with the UK GDPR and Irish Data Protection Act. Since India is a “third country,” we use Standard Contractual Clauses (SCCs) and International Data Transfer Agreements (IDTAs) to ensure your data receives the same protection as it would in the UK/EU.

5.2 USA (CCPA/CPRA)

We act as a “Service Provider” under the California Consumer Privacy Act. We do not “sell” or “share” personal information for marketing purposes.

5.3 Canada (PIPEDA)

We adhere to the ten fair information principles of PIPEDA, ensuring accountability and limiting collection to only what is necessary for accounting purposes.

5.4 Australia & New Zealand

We comply with the Australian Privacy Principles (APPs) and the NZ Privacy Act 2020, specifically regarding the secure handling of TFNs (Tax File Numbers) and other sensitive identifiers.

6. DATA RETENTION

We do not store end-client data longer than necessary.

• Trial Data: Deleted within 30 days if a formal engagement is not signed.
• Active Clients: Data is retained for the duration of the contract. Upon termination, we return or destroy all data as per your instructions.

7. YOUR RIGHTS

Depending on your location, you (and your clients) may have the right to:

• Access the data we hold.
• Rectify inaccuracies.
• Request Deletion (“Right to be Forgotten”).
• Restrict Processing or object to data transfers.
